What is average car injury soft tissue settlement for GA?
On four lane highway with turning lane doing 35 and guy attemps to cross 2 lanes where my vision and his was obstructed by inner lane of traffic that was stopped. I did not get to brake…. car totaled, arm bruised from bag, but walked away with no blood nor broken bones…. whiplash, of course, and soft tissue. Outside of medical bills (e.g. $4k for PT), what can one expect in GA for a settlement for pain and suffering which was a year of muscular discomfort?
You will need to prove that your “muscular discomfort” actually lasted for one year. Soft tissue injuries should resolve themselves within 12 weeks perhaps even 16. You will need medical documentation that supports your allegations. Soft tissue injuries are usually evaluated based on the length of your total and partial disability. The medical report will usually indicate your length of disability.
I am sure the adjuster has complete his/her liability assessment by now. If they feel that you contributed to the accident, then the settlement value will be reduced by your percentage of comparative negligence.
FYI – insurance companies do not formula price. For example, meds multiplied by some random number like three.
